Terms & Conditions of Sale

These Terms & Conditions govern all sales and services provided by Overtype, a type design foundry run by Inès Davodeau & Tim Vanhille.
By purchasing or using our fonts, you agree to these terms.

The fonts sold here are digital files (OTF, WOFF, WOFF2, and variable formats). Purchasing a font does not transfer ownership of the file. It grants a specific usage right defined by the license.

The license is granted to the final end-user entity (company, organization, freelancer). Agencies or intermediaries must ensure the license is purchased in the name of their client.

Fonts may be reused as many times as needed, as long as the usage stays within the licensed entity.

Logos & wordmarks require the dedicated “logo/wordmark use” option, available at checkout.

Resale, sublicensing, or free sharing of the font files is strictly forbidden.

You may share the files with third-party collaborators (printers, developers, etc.) only if necessary for your licensed project. These collaborators cannot reuse the files for other clients or projects.

Fonts must not be used in any illegal, hateful, discriminatory, or rights-infringing context.

Overtype reserves the right to refuse or terminate any collaboration in case of violation.

All fonts, texts, visuals, data, and content on this website are the exclusive property of Overtype, unless otherwise stated.

Any unauthorized reproduction, modification, distribution, or resale is strictly prohibited.

No part of the font files, specimens, or website content may be extracted, modified, or redistributed outside the scope of the granted license.

In addition to retail fonts, Overtype also offers:

— Bespoke typefaces (built from scratch or adapted from retail fonts)
— Custom logos, wordmarks, and lettering
— Type consulting and creative direction services

These services are subject to custom quotes and specific copyright agreements.

Payments are handled securely via Paddle, our official distributor for digital products. Prices are displayed excluding VAT.

VAT is automatically added at checkout based on your location, in line with international tax laws.

Paddle acts as the Merchant of Record and is responsible for VAT collection.

Font files are delivered by email after purchase.It is your responsibility to store the files securely, as permanent download access is not guaranteed.

If you don’t receive the files, contact us at contact@overtypefoundry.com with your proof of purchase.

Because our products are digital files, refunds are not possible (in line with EU law).

If a font file is defective, email us with your proof of purchase and we’ll fix or resend the files as quickly as possible.

Discounts applied to certain styles when purchased together (for example, a reduced price on Regular Italic when buying Regular) are only valid if the styles are acquired simultaneously. They do not apply retroactively if a style is purchased at a later date.

Similarly, preferential pricing offered through bundles or complete packs cannot be applied if styles are purchased separately, one by one.

The prices displayed on the website are those in effect at the time of purchase; any subsequent price changes (increase or decrease) do not entitle the buyer to a price adjustment or refund.

Overtype reserves the right to modify or withdraw a discount or offer at any time, without prior notice.

Fonts are provided “as is”, tested on modern systems and software.

We do not guarantee compatibility with outdated or unsupported operating systems or applications.

Overtype provides no warranty of fitness for a particular purpose.

The user is solely responsible for ensuring the fonts are suitable for their intended use.

Overtype cannot be held responsible for direct or indirect damages, including data loss, print errors, software issues, or other problems resulting from the use of the fonts.

Overtype may suspend access to the website at any time for maintenance or technical reasons.

We are not responsible for external websites linked from our site.

Overtype cannot be held liable for errors, interruptions, or data loss related to the website or download services.

Overtype is not liable for delays or failure to perform due to events beyond our control, including natural disasters, strikes, communication breakdowns, or other force majeure events.

Overtype reserves the right to update these Terms & Conditions at any time. The version applicable is the one in effect at the time of your purchase.

These Terms & Conditions are governed by French law.
In case of a dispute, we will always seek an amicable resolution first. If necessary, the courts of Marseille will have exclusive jurisdiction.
